These Terms and Conditions govern the use of services provided by Avioptix ("we," "us," or "our"). By accessing or using our services, you ("Client" or "you") agree to abide by these Terms and Conditions.

2. Services Offered
Avioptix provides a range of drone-based services, including:

Drone-based mapping and monitoring

Orthomosaic Maps
-
Digital Elevation Models (DEM)
-
3D Site Scan
-
Stockpile Analysis
-
Progress Monitoring
All services come with a detailed written report. All deliverables will be provided within 5 business days of the flight date.
3. Pricing and Payments

Payment Terms: Payment is due upon delivery of services, and invoices will be emailed to clients.

Payment Method: Payment must be made via bank transfer.

Refund and Cancellation Policy:

Clients may cancel at any time up until the day of the shoot with no penalty, but a cancellation fee of £50 will apply.

Cancellations after the flight has been conducted will incur a £300 fee, and no deliverables will be sent.

Refunds are only granted in cases where there is a significant fault with the deliverable. In such cases, the client may choose to receive either a refund or a new flight with no additional charge.

Late Payment: Payments are due within one month of the invoice date. Late payments will incur a fine of £50 per week. If payment is not received within 2 months, legal action may be taken.

Taxes: Taxes are not applicable.
4. Client Obligations
The Client is responsible for providing site access to facilitate the flight.
5. Delivery and Timeline

Data will be delivered within 48 hours after the flight.

Deliverables may include any combination of GeoTIFF, JPG, CAD, or PDF formats, depending on the service requested.
6. Liabilities and Limitations

Flight Cancellations: We reserve the right to cancel a flight in the event of rain or extreme wind.

Third-Party Failures: We are not liable for any issues or delays caused by third-party equipment failures, incorrect data, or unforeseen site conditions.

Accuracy of Data: Due to environmental conditions or site-specific restrictions, we cannot guarantee the accuracy of data.

Not an Official Surveying Service: Avioptix does not serve as official site surveyors. The maps and deliverables provided are intended solely for planning, monitoring, and visualisation purposes. They are not certified for legal or regulatory compliance requirements.
7. Intellectual Property

Upon payment receipt, the Client will hold full ownership of the data and deliverables.

Clients are free to use, modify, or resell the deliverables.

Permission for Sharing: With the Client’s consent, Avioptix may share the data on its website as an example of its work. The Client can revoke this consent at any time.
8. Confidentiality

All data is considered confidential and will only be shared between Avioptix and the Client, unless otherwise specified by the Client.

Confidentiality is maintained indefinitely unless the Client agrees otherwise.
9. Dispute Resolution

Any disputes will be resolved through arbitration.

Jurisdiction: These Terms and Conditions are governed by the laws of the United Kingdom.
10. Term of Agreement

These Terms and Conditions apply to one-time agreements, except in the case of project monitoring, where they remain in effect for the duration of the monitoring.

The agreement is automatically terminated once payment is received.

Either party can terminate the agreement at any time through verbal agreement.

The agreement may also be terminated in the event of a breach of terms.
